Inappropriate?We began using FlashMoto on the 30/11/2009 on behalf of our client Sticks ClothingTM who purchased it for development of his website. He originally wanted a flash website that he could edit the contents of himself to save money on content management.
We believe that FlashMoto has displayed Deceptive and Misleading Conduct through their advertising to consumers. False claims have been made in regards to the performance characteristics and benefits of both the FlashMoto product and its services. These claims can in no way be mistaken as just ‘puffery’ in advertising language but they communicate specific points that are not entirely true.
Our case for Deceptive and Misleading Conduct began with a lack of appropriate response to our community-based queries and support tickets on issues relating to our clients concerns.

Assistance for non-ActionScript savvy developers - 3 months ago
- This post was ‘answered’ by Demetrio Fortman with promise of tutorials. This is our first concern in that (as pictured below) a statement was made that FlashMoto has ‘Comprehensive Documentation and Tutorials’. This is a very inflammatory statement since some basic tutorials are only in development and the word ‘comprehensive’ implies to the consumer that any reservations they may have about their lack of knowledge is not of concern.
Is this CMS suitable for a non-web savvy client? – 1 month ago
- Demetrio Fortman answered with “Please check out FlashMoto Control Panel online DEMO to check if it is suitable for non-web savvy clients. We are working on different user roles in the control panel, there is no such a feature for now, but If you are develop[er you can lock different objects in the XML. So it is possible”. The issue here is that most people have already been lured into purchasing FlashMoto through its misleading advertisements. Demetrio’s response is slightly too ambiguous to be clearly understood and is an indication that the CMS may very well not be suitable but ‘could possibly be?’

You have failed to respond to over 3 emails and closed all of our unresolved support tickets. We, as we have stated numerous times in our one way correspondence, have a client that feels your advertising was misleading and your attitude toward this issue is unethical. We wish to open a discussion concerning a refund of the product. It would be a good idea to get in contact with us through Get Satisfaction or directly as soon as possible.
This sparked a sudden response to all of our unanswered issues from the last few months.
Demetrio’s response was as follows:
Hello Dave, we will try to resolve all of your issues and find all the answers on your questions. We have checked your unresolved tickets - all of them are community questions. We will check out and answer all of them as soon as possible. Please feel free to ask any questions there, developers questions are greatly appreciated. All the refund requests and questions you can send to support@flashmoto.com. Thank you.
All the responses were adequate and well explained. However what the FlashMoto moderator failed to understand is that is not what we are asking for anymore. Our client is unhappy with the lack of response and with the misleading conduct. Our client wishes to obtain his rightful refund.
As for the refund requests and questions I also found a response to another post on FlashMoto’s refund policy where Demetrio can be quoted as saying, “FlashMoto doesn't offer satisfaction money back for now. We are releasing product TRIAL in march, you can check our online demo, help center and ask your questions at support.flashmoto.com and our community. All the refund requests and questions you can send to support@flashmoto.com. Thank you.” I hope that in underlying the word ‘TRIAL’ we aren’t to assume that we are not entitled to a refund due to our own fault in TRIALING their product.
To not resolve this issue by producing a refund is a violation of our statutory rights as consumers.
Our concerns with the Deceptive and Misleading Conduct are below with reference to the picture attached.
FlashMoto are stated as claiming the following:
1) Advanced WYSIWYG Editor – Editing Flash website is as easy as editing document in Word
2) Comprehensive Documentation and Tutorials, and
3) No Skills Required
Our case clearly demonstrates that there is a massive difference in the claims made in regards to the performance characteristics and benefits of both the FlashMoto product and its service, and what you are actually provided with.
We suggest that if your case is not resolved to your satisfaction to contact your country’s Consumer Watchdog or visit the website of the International Consumer Protection and Enforcement Network’s e-commerce division at www.econsumer.gov.

There are obviously a few kinks to iron out of the advertisements but Demetrio's response displays an integrity that is lacking in most businesses.

I've taken a look at ticket statistics aтв discovered that most of your tickets were resolved quickly. Unfortunately, we cannot provide 24-hour support right now, but we are doing everyting possible to help our clients.
We will certainly refund your product. Please send us your product id or account email and we will immediately send you a waiver of copyright to proceed with refund process. You will have to sign it and send us a copy. You will get your money back in 2-3 days.
We'd also like to present you any one of our templates together with a license for FlashMoto CMS. Please tell us what account you'd like us to add it to (or we can create a new account for you)

It is really gracious of you to offer us a copy of the FlashMoto CMS licence and a template. Please understand that we think FlashMoto CMS is a powerful and extremely useful program. Clients and the non-web savvy just need to know what they are getting into or have it recommended by a designer that is already experienced in its capabilities. If we can have FlashMoto added to a new account for **********, hopefully, as documentation and tutorials grow we can increase our understanding of FlashMoto and recommend it to clients when it is suitable for them.

Inappropriate?I haven't purchased a template yet, but what I have seen, in both product description and the deliverable (via demos), have been quite accurate. If you want to see deceptive advertising/marketing check out flashmint -- this is where I am coming from.
Flashmint uses deception to sell their templates. I purchased a Business CMS template because they say:
"NO SOFTWARE REQUIRED" on one page. Then on another they state:
"this flash template is based on "Business CMS" engine and NO SOFTWARE REQUIRED to make changes."
And in another location the claim:
"The main feature of our new product is that you can now have a highly interactive flash website without having to purchase or use any flash editor"
In addition, on the same page its mentioned that the fla file is provided for "advanced users."
I was all excited; here I thought I was going to build a beautiful flash site. A few minutes later after getting started I discovered I could not find a way to add a hyperlink to the Learn More button on the page. After some fruitless digging I ask support. They told me that would require Flash to edit the fla file. So I went from excited to dejected.
I pointed out to them that the site claims no software required. They replied back by pointing out the "note" which states: "We supply Business CMS with flash animated elements that require Adobe Flash CS3+ to edit."
That's all fine and dandy. What they forget to mention, or conveniently left unspoken, is that there are flash elements that will require editing if you want to build the site! In the presence of all the claims of "no software required" this sounds like editing the fla file is just an option if you want to do some optional customization -- not a requirement for building the site in the first place
I decide to give it a try and download Flash trial. After a couple hours of reading and playing with the fla file I get no where. I bring up my concerns and frustrations to them (in a nice way) and ask them to point me in the right direction to complete the single task of adding a hyperlink to their Learn More button. Their response was: "Unfortunately teaching flash is beyond the scope of our support service."
I feel I was ripped off. I am so disgusted with them I don't even want to ask for my money back. -
Hello dean, could you please provide us with the template number?
There is no problem to add hyperlinks to the buttons or text in FlashMoto and you don't need Flash IDE to do that. -

Inappropriate?Unfortunately, the Flash template # 2430 is not a FlashMoto template, so we can't provide support for it. Please, contact the Support Team of the company where you have bought the product.

Inappropriate?If a company is not willing to stand by its product, what good is the product to consumers?
My company purchased Flashmoto software for a client at 2:20 pm 6/2/2010, by 3:40 we had already used 3 activations in the flashmoto software trying to edit 1 flash site because the advertisement said "There are no restrictions in website design and animation" (but there is). At 6:30pm (4 hours) we realized that the flashmoto software was not in the best interest for our company and definitely not for our clients needs. We even tried the flashmoto software on 3 more different flash sites to make sure it wasn't on our end. After many aggravating attempts with the flasmoto software and 6 useless activations I sent the below correspondance letter to Mr. Fortman, hoping for a reply. but to no surprise, still haven't heard anything in reply about refunding our client for the flashmoto software that will not be used at all.

As you can see from your invoice, I purchased flashmoto merely hours ago. I am requesting a refund due to the fact this product is not what we believed it to be. We have waited many months since the beta to purchase this product, the features aren't what we expected neither is the fact we can't use this with every flash file we tryed to upload to many of our client servers. I personally tryed e-mailing your company for support regarding a few matters but to no avail. I am now in the office 2 and a half hours past the end of my shift because I tryed to understand the dynamics of this program when the truth is I am dissatisfied with the functionality of what I thought was a completely different product. After sending the above message with no reply, hopefully some resolve will come of this from this forum post. I feel that it may be time to turn to the blogging and forum community to help spread awareness about flashmoto software as a misleading product and the company behind it. And YES, we followed protocol by contacting support@flashmoto.com first.
